Terms of Service

These Terms govern your use of Hedge AI Labs (hedgeailabs.com and app.hedgeailabs.com, the "Service"). By creating an account or using the Service you agree to them. If you do not agree, do not use the Service.

1. What the Service is — and is not

Hedge AI Labs is a research and education tool. It provides analysis, historical backtesting, forward simulations, and user-configured market notifications ("AI Scanners").

• The Service does not provide investment, legal, or tax advice; nothing on it is a recommendation to buy, sell, or hold any security, derivative, or digital asset.
• The Service does not execute trades, hold funds or securities, or exercise any discretion over any account. We are not a broker-dealer, investment adviser, or commodity trading advisor, and no advisory or fiduciary relationship is created by your use.
• Scanner and strategy notifications are factual reports that conditions you defined were observed in market data. They are not instructions or signals to act.
• All trading decisions, and their outcomes, are yours alone. Trading involves substantial risk of loss.

2. Hypothetical performance

Backtested and simulated results shown by the Service are hypothetical. Hypothetical performance has inherent limitations: it does not reflect actual trading, may not account for all fees, slippage, liquidity, or market impact, and is designed with the benefit of hindsight. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown. Past performance does not predict future results.

3. Accounts and acceptable use

• You must provide accurate information and keep your credentials secure; you are responsible for activity under your account.
• You may not attempt to breach, probe, or overload the Service or its sandboxes; access other users' data; scrape or resell Service output or underlying market data; or use the Service for any unlawful purpose.
• We may suspend or terminate accounts that violate these Terms.

4. Credits and payments

Paid features consume credits. Credits are a prepaid license to use the Service, have no cash value, are non-transferable, and are non-refundable except where required by law. Payments are processed by Stripe; we do not store card details. Pricing may change prospectively.

5. Notifications (email and SMS)

Scanner alerts are sent to your account email. If you enable SMS delivery you consent to receive automated text messages at the number you provide for the alerts you configured; message and data rates may apply; reply STOP to opt out at any time. Your request to enable SMS, and the number provided, are recorded as your consent.

6. Intellectual property and your content

The Service, including its software and analysis engine, is our property. You retain your rights in files you upload and strategies you describe; you grant us a license to process them solely to operate the Service for you. Market data is provided by third-party sources and may not be redistributed.

7. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, COMPLETENESS, TIMELINESS OF DATA OR ALERTS, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. DATA AND ALERTS MAY BE DELAYED, INTERRUPTED, OR ERRONEOUS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEDGE AI LABS AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY TRADING LOSSES OR FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, AND OUR AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.

8. Indemnity

You will indemnify and hold us harmless from claims arising out of your use of the Service in violation of these Terms or applicable law.

9. Disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflicts rules. Any dispute shall be resolved by binding individual arbitration; you waive any right to participate in a class action. Either party may bring qualifying claims in small-claims court.

10. Changes

We may update these Terms; material changes will be notified in the Service or by email, and continued use after the effective date constitutes acceptance.
